Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dashduck (the "Service").
1. Provider and contact

2. Who these Terms apply to
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization ("Business Customer").
If you use the Service as an individual, you are a "Consumer" (where applicable).
3. The Service
Dashduck allows users to upload spreadsheets (Excel/CSV), store files and extracted data, and generate interactive dashboards, including through automated/AI-based functionality.
4. Account, access, and security
You must create an account to use the Service. Login may be passwordless (email code). You are responsible for maintaining the confidentiality of login methods and for all activity under your account.
5. Your Content and responsibilities
"Customer Content" means any files, data, text, dashboards, configurations, or other content you upload or generate through the Service.
You are responsible for:
- ensuring you have all necessary rights and permissions to upload and use Customer Content
- ensuring Customer Content does not violate law or third-party rights
- ensuring you have a lawful basis to process any personal data contained in Customer Content
You must not upload content that is unlawful, infringes rights, or is harmful. You should not upload special category/sensitive data unless you have a lawful basis and understand the risks.
6. Public sharing and links
The Service may allow you to share dashboards via a public link. If you enable public sharing, anyone with the link may access the shared dashboard. You are solely responsible for what you share and with whom.
7. Teams and invitations
You may invite team members. Unless otherwise stated in the product, all invited team members may have similar access. You are responsible for your team members' actions.
8. AI features and disclaimers
The Service may use automated or AI-based systems to generate dashboards or insights. Outputs may be inaccurate or incomplete. You are responsible for reviewing and validating results before relying on them. The Service does not provide professional advice.
9. Subscription, billing, and trials
The Service is offered on a subscription basis (e.g., $29/month) via Stripe or another payment provider.
- Auto-renewal: subscriptions renew automatically until cancelled.
- Trial: if offered (e.g., 14 days), usage limits may apply.
- Limits: you may be subject to plan limits (e.g., max dashboards; file size limit like 15MB). We may enforce limits to protect service stability.
Taxes/VAT may apply depending on your location and status.
10. Changes to the Service and pricing
We may change the Service, features, and pricing. We will provide reasonable notice of material changes. New pricing typically applies from the next renewal date.
11. Availability
The Service is provided on a best-effort basis without any uptime guarantee unless you have a separate written SLA.
12. Intellectual property
We own the Service and all associated intellectual property. You retain ownership of your Customer Content. You grant us a limited right to host, process, and display Customer Content solely to provide and improve the Service.
13. Aggregated/anonymized data
We may use aggregated and/or anonymized usage data and statistics to improve the Service, provided such data does not identify you or any individual.
14. Privacy and data protection
Our Privacy Policy describes how we process personal data. If you are a Business Customer and we process personal data contained in Customer Content on your behalf, the Data Processing Agreement ("DPA") applies.
15. Suspension and termination
You may cancel your subscription at any time (typically effective at the end of the current billing period). We may suspend or terminate access if you violate these Terms or use the Service in a way that harms the Service or others.
16. Data deletion and retention
When you delete a dashboard, we delete associated extracted data and the original uploaded file within 24 hours (or apply a recovery window of 30 days if you enable it).
After cancellation, we retain Customer Content for 30 days to allow export/restore, then delete it.
Backups (when enabled) may retain data for up to 90 days on a rotating basis.
17. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
18. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential or punitive damages.
- Our total liability is limited to the amounts you paid to us in the three (3) months before the event giving rise to liability (or $100 if you paid nothing).
19. Governing law
These Terms are governed by Norwegian law. Disputes shall be brought before the courts of [VENUE, e.g., Oslo District Court], unless mandatory law provides otherwise.
